a) A reference to a statute or statutory provision is a reference to it as amended or re-enacted. A reference to a statute or statutory provision includes any subordinate legislation made under that statute or statutory provision, as amended or re-enacted.
b) Any phrase introduced by the terms including, include, in particular or any similar expression, shall be construed as illustrative and shall not limit the sense of the words preceding those terms.
c) A reference to writing or written includes email.


2.1. The Order constitutes an offer by the Customer to purchase Services in accordance with these Conditions.
2.2. The Order shall only be deemed to be accepted when myfamilygenealogy.co.uk; Robert Parker issues written acceptance of the Order (for example a Research Proposal, or payment for services, or a consent to receive services) at which point and on which date the Contract shall come into existence (Commencement Date).
2.3. The service or product shall only be deemed to be accepted by the customer when written acceptance is received (for example the payment for services, or a consent to receive services) at which point and on which date the Contract shall come into existence (Commencement Date).


3.1. myfamilygenealogy.co.uk; Robert Parker shall supply the Services to the Customer in accordance with the Specification in all material respects.
3.2. myfamilygenealogy.co.uk; Robert Parker shall have the right to make any changes to the Services which are necessary to comply with any applicable law or safety requirement, or which do not materially affect the nature or quality of the Services, and myfamilygenealogy.co.uk; Robert Parker shall notify the Customer in any such event.
3.3. myfamilygenealogy.co.uk; Robert Parker warrants to the Customer that the Services will be provided using reasonable care and skill.


4.1. The Customer shall:
a) ensure that the terms of the Order and any information it provides in the Specification are complete and accurate;
b) co-operate with myfamilygenealogy.co.uk; Robert Parker in all matters relating to the Services;
c) provide myfamilygenealogy.co.uk; Robert Parker with such information and materials as myfamilygenealogy.co.uk; Robert Parker may reasonably require in order to supply the Services, and ensure that such information is accurate in all material respects;
4.2. If myfamilygenealogy.co.uk; Robert Parker’s performance of any of its obligations under the Contract is prevented or delayed by any act or omission by the Customer or failure by the Customer to perform any relevant obligation (Customer Default):
a) myfamilygenealogy.co.uk; Robert Parker shall without limiting its other rights or remedies have the right to suspend performance of the Services until the Customer remedies the Customer Default, and to rely on the Customer Default to relieve it from the performance of any of its obligations to the extent the Customer Default prevents or delays myfamilygenealogy.co.uk; Robert Parker’s performance of any of its obligations;
b) myfamilygenealogy.co.uk; Robert Parker shall not be liable for any costs or losses sustained or incurred by the Customer arising directly or indirectly from myfamilygenealogy.co.uk; Robert Parker’s failure or delay to perform any of its obligations as set out in this clause; and
c) the Customer shall reimburse myfamilygenealogy.co.uk; Robert Parker on written demand for any costs or losses sustained or incurred by myfamilygenealogy.co.uk; Robert Parker arising directly or indirectly from the Customer Default.


5.1. Myfamilygenealogy.co.uk’ Robert Parker shall comply with all applicable laws and Advertising Regulations issued, made or given by any Advertising Regulator.


6.1. Condition 6.2 shall apply if the Services are to be provided on a time-and-materials basis. Condition 6.3 and condition 6.4 shall apply if the Services are to be provided for a fixed price. The remainder of this condition 6 shall apply in either case.
6.2. Where the Services are provided on a time-and-materials basis:
(a) the charges payable for the Services shall be calculated in accordance with myfamilygenealogy.co.uk; Robert Parker’s standard hourly or daily fee rates as amended from time to time;
(b) myfamilygenealogy.co.uk; Robert Parker’s standard hourly or daily fee rates (as published from time to time) are calculated on the basis of an seven-hour day worked between 9.00 am and 5.00 pm on weekdays (excluding weekends and public holidays);
(c) myfamilygenealogy.co.uk; Robert Parker shall be entitled to charge it’s standard hourly or daily fee rate (as published from time to time) for each hour worked outside the hours referred to in condition 5.2(b) on a pro-rata basis;
(d) myfamilygenealogy.co.uk; Robert Parker shall invoice the Customer in advance for its charges for time, expenses and materials (together with VAT where appropriate) for the service concerned, calculated as provided in this condition 6. Each invoice shall set out the service to be provided, an estimate of time required and a breakdown of any expenses and materials required to conduct the service.
6.3. Where the Services are provided for a fixed price the total price for the Services shall be the amount set out in the Specification. The total price shall be paid to myfamilygenealogy.co.uk; Robert Parker in one amount or in instalments as set out in the Specification. All amounts due under this agreement shall be paid by the Customer to myfamilygenealogy.co.uk; Robert Parker in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law).
6.4. Any fixed price contained in the Specification excludes:
(a) the cost of any licences, materials or services reasonably and properly provided by third parties required by myfamilygenealogy.co.uk; Robert Parker for the supply of the Services. Such materials and third party services shall be invoiced by myfamilygenealogy.co.uk; Robert Parker at cost; and
6.5. The Customer shall pay each invoice submitted to it by myfamilygenealogy.co.uk; Robert Parker in full, and in cleared funds, within 30 days of receipt.
6.6. All payments payable to myfamilygenealogy.co.uk; Robert Parker under the Contract shall become due immediately on termination of the Contract, despite any other provision. This condition is without prejudice to any right to claim for interest under the law, or any such right under the Contract.


7.1. All Intellectual Property Rights in or arising out of or in connection with the Services shall be owned by myfamilygenealogy.co.uk; Robert Parker.
7.2. The Customer acknowledges that, in respect of any third party Intellectual Property Rights, the Customer’s use of any such Intellectual Property Rights is conditional on myfamilygenealogy.co.uk; Robert Parker obtaining a written licence from the relevant licensor on such terms as will entitle myfamilygenealogy.co.uk; Robert Parker to license such rights to the Customer. The Customer shall be responsible for any licence fees in relation to such third party Intellectual Property Rights.
7.3. All Deliverables prepared by myfamilygenealogy.co.uk; Robert Parker and paid for by the Customer will be the Customer’s property but the Customer will not necessarily own the copyright(s) or other Rights in it.


8.1. Any reference in this Agreement to the Customer’s “Written Approval” shall mean written approval by the Customer authorised to approve myfamilygenealogy.co.uk; Robert Parker’s work (“Authorised Person”).
8.2. The Customer will notify myfamilygenealogy.co.uk; Robert Parker in writing of any change to the Authorised Persons. myfamilygenealogy.co.uk; Robert Parker shall not be responsible for any delay in the performance of the Services resulting from the unavailability of an Authorised Person to provide approval.


9.1. The Customer may request myfamilygenealogy.co.uk; Robert Parker to cancel or amend any and all work in progress. myfamilygenealogy.co.uk; Robert Parker will take all reasonable steps to comply with any such request provided that the Customer is able to do so within its contractual obligations to third party suppliers.

9.2. In the event of any such cancellation or amendment the Customer will reimburse myfamilygenealogy.co.uk; Robert Parker for any charges or expenses incurred by myfamilygenealogy.co.uk; Robert Parker to which myfamilygenealogy.co.uk; Robert Parker is committed. The Customer shall also pay myfamilygenealogy.co.uk; Robert Parker’s Charges covering the cancelled or amended Services as well as any charges imposed on myfamilygenealogy.co.uk; Robert Parker by third parties arising from the cancellation or amendment.


10.1 If there is an error in the Deliverables as published or publication is delayed or does not occur as planned, myfamilygenealogy.co.uk; Robert Parker will not be liable unless this is caused by its default or neglect.

10.2 The Customer warrants that to the best of its knowledge information and belief all Customer Information supplied to myfamilygenealogy.co.uk; Robert Parker before and during the Term will be accurate and not in any way contrary to English law.


11.1. Nothing in the Contract shall limit or exclude myfamilygenealogy.co.uk; Robert Parker’s liability for:
• death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
• fraud or fraudulent misrepresentation; or
• any other liability which cannot be limited or excluded by applicable law.
11.2. Subject to clause 11.1, myfamilygenealogy.co.uk; Robert Parker shall not be liable to the Customer, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for:
▪ loss of profits;
▪ loss of sales or business;
▪ loss of agreements or contracts;
▪ loss of anticipated savings;
▪ loss of use or corruption of software, data or information;
▪ loss of damage to goodwill; and
▪ any indirect or consequential loss.
11.3. Subject to clause 8.1, myfamilygenealogy.co.uk; Robert Parker’s total liability to the Customer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract shall be limited to the total Charges paid under the Contract.
11.4. This clause 8 shall survive termination of the Contract.


12.1. Without limiting its other rights or remedies, either party may terminate the Contract by giving the other party written notice.
12.2. Without limiting its other rights or remedies, myfamilygenealogy.co.uk; Robert Parker may terminate the Contract with immediate effect by giving written notice to the Customer if:
a) the Customer fails to pay any amount due under the Contract on the due date for payment and remains in default not less than 7 days after being notified to make such payment; or


On termination of the Contract for any reason:
a) the Customer shall immediately pay to myfamilygenealogy.co.uk; Robert Parker all of myfamilygenealogy.co.uk; Robert Parker ‘s outstanding unpaid invoices and interest and, in respect of Services supplied but for which no invoice has been submitted, myfamilygenealogy.co.uk; Robert Parker shall submit an invoice, which shall be payable by the Customer immediately on receipt


14.1. Force majeure. Neither party shall be in breach of this Contract nor liable for delay in performing, or failure to perform, any of its obligations under this Contract if such delay or failure result from events, circumstances or causes beyond its reasonable control.
14.2. Assignment and other dealings.
a) myfamilygenealogy.co.uk; Robert Parker may at any time assign, transfer, mortgage, charge, subcontract or deal in any other manner with all or any of its rights under the Contract and may subcontract or delegate in any manner any or all of its obligations under the Contract to any third party or agent. Written notice of this will be provided to the customer ten working days before any assignment, transfer, mortgage, charge, subcontract or deal is made
14.3. Confidentiality.
a) Each party undertakes that it shall not at any time during the Contract, and for a period of five years after termination of the Contract, disclose to any person any confidential information concerning the business, affairs, customers, clients or suppliers of the other party, except as permitted by clause b.
b) Each party may disclose the other party’s confidential information:
.to its employees, officers, representatives, subcontractors or advisers who need to know such information for the purposes of carrying out the party’s obligations under the Contract. Each party shall ensure that its employees, officers, representatives, subcontractors or advisers to whom it discloses the other party’s confidential information comply with this clause 14.3; and
.as may be required by law, a court of competent jurisdiction or any governmental or regulatory authority.
c) Neither party shall use the other party’s confidential information for any purpose other than to perform its obligations under the Contract.
14.4. Entire agreement.
a) This agreement constitutes the entire agreement between the parties (including any product specific terms and conditions; for example Courses Terms and Conditions & Research Terms and Conditions) and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

14.5. Variation. No variation of the Contract shall be effective unless it is in writing and signed by the parties (or their authorised representatives).
14.6. Waiver. A waiver of any right or remedy is only effective if given in writing and shall not be deemed a waiver of any subsequent breach or default. A delay or failure to exercise, or the single or partial exercise of, any right or remedy shall not:
a) waive that or any other right or remedy; or
b) prevent or restrict the further exercise of that or any other right or remedy.
14.7. Severance. If any provision or part-provision of the Contract is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of the Contract.
14.8. Notices.
a) Any notice or other communication given to a party under or in connection with the Contract shall be in writing, addressed to that party at its registered office or such other address as that party may have specified to the other party in writing in accordance with this clause, and shall be delivered personally, or sent by pre-paid first class post or other next working day delivery service, commercial courier, or email.
b) A notice or other communication shall be deemed to have been received: if delivered personally, when left at the address referred to in clause a; if sent by pre-paid first class post or other next working day delivery service, at 9.00 am on the second Business Day after posting; if delivered by commercial courier, on the date and at the time that the courier’s delivery receipt is signed; or, if sent by email, one Business Day after transmission.
c) The provisions of this clause shall not apply to the service of any proceedings or other documents in any legal action.
14.9. Third parties. No one other than a party to the Contract shall have any right to enforce any of its terms.
14.10. Governing law. The Contract, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.
14.11. Jurisdiction. Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.

15. Research Terms and Conditions

a) All family history research conducted is based on the information provided by you, the customer. Please ensure you check the information provided before submitting, highlighting sources of information wherever possible. Please provide electronic or paper copies of documents relating to any research carried out previously, in any of the formats detailed below**.

b) Research package, hourly rate or day rate quoted includes all travel expenses within 20 mile radius of St Neots, Cambridgeshire, UK. This includes, for example, visits to Cambridgeshire and Huntingdonshire Archives.

c) An invoice will be submitted in advance for any research undertaken. Payment terms, and options are detailed on the invoice. Research will begin once payment has been received and cleared. For hourly and day rate customers a research proposal will be submitted to the client by myfamilygenealogy.co.uk before or with the first invoice.

d) All research is backed up with a written research report (delivered by post or email), with summary and detailed information on the research undertaken, sources consulted, a breakdown of hours used vs cost, plus appendices**. Copies of any original records or reproduced images of them (e.g. General Register Office Certificates of Birth & Marriage) or other primary sources (for example the UK population Census) will be provided. Production of this report is part of the agreed number of research hours and normally constitutes 20% of the time agreed.

e) All research packages (Bronze, Silver or Gold) are backed up with a GED format file***, with a backup file (rmgb – based on the RootsMagic software****) and an ancestor report, plus electronic family tree in descent format.

f) Research may be conducted via the Internet and/or at UK record offices. For hourly or day rate customers record offices in Cambridgeshire, Hertfordshire, Bedfordshire, Northamptonshire, Suffolk, Essex and Norfolk can be consulted easily. See ‘http://www.myfamilygenealogy.co.uk/research-sources’ for a list of these archives and the sources available. If archives in other counties are to be visited, this will be communicated prior to the visit to the client, and a cost agreed to cover travel and research time.

g) For hourly or day rate customers vital family history records (birth, baptism, marriage or death / burial records or certificates) are charged at cost (GRO* current rate) plus £1.00 administration fee (per certificate) which covers ordering and forwarding. For research package customers the following total number of certificates (when I am able to source these) will be provided:
◦ Bronze = 9, Silver = 18, Gold = 36

h) For hourly or day rate customers census images are provided at a cost of £7.00 per page, including a transcription. For research package customers these are included in the research package price.

i) Other records or copies of records; charges are advised by request. Please inform myfamilygenealogy.co.uk if you wish to agree these charges before they are incurred.

j) Disclaimer: As with any research no guarantee can be made regarding the records, data or information that may or may not be found in my searches. You are purchasing my knowledge of family history research, the techniques I have honed over many years and access to the sources I use. I will access the most appropriate sources in the most efficient way. I will share all information gleaned from these sources. Please be aware the information provided may reveal details about your family you are unaware of or that contradicts family memories. Having stated this I will work hard to provide accurate, relevant and clear information to help you appreciate who you are, by uncovering your past and building your family tree.

k) My intellectual property is any reports, proposals, emails, letters and communication I create and enter into with you, the client. Certificates, Census images, transcriptions and images of genealogy records will normally contain copyright from the original supplier. Please contact me in all circumstances should you wish to reuse, publish, copy, send via paper or electronic means any of these materials before reproducing them. I may use client research in my lectures, talks, training courses, articles to inform or teach others. I may use client research in my ongoing development, certification or evidence for the professional bodies I am a member of.

l) I will retain all reports and documents related to this research for a period not to exceed three years after completion of the research project.

m) I maintain my knowledge and skills with regular continuing professional development. Reading, attending conferences and lectures and researching up to date, best practice in genealogy. I belong to The Association of Professional Genealogists (APG), The Society of Genealogists and a couple of UK Family History Societies.

n) Please confirm you agree to, and accept these terms and conditions in writing (by email or letter) when paying the first invoice. Payment received for the first invoice indicates you have agreed and accept these terms and conditions.

16. Courses Terms and Conditions

It is important for you to understand clearly, when you make a booking with myfamilygenealogy.co.uk (Robert Parker) for a face to face taught course or buy an online course from me, who is responsible for what. This document sets out clearly which responsibilities lie where. The following are the terms of the contract between you and us; myfamilygenealogy.co.uk; Robert Parker.

a) All family history courses are based on sound research by myfamilygenealogy.co.uk (Robert Parker). As such the techniques and sources discussed in my courses are tried and tested.

b) The content of the training course (learning outcomes) is detailed in the course description. The course description includes who the course is suitable for, an outline of content and any materials you as the customer should consider providing. For face to face taught courses details of the trainer, venue, date and time will be included. Also refreshments provided are also described.

c) A total cost, is detailed; this is the total cost you will pay (excluding travel, parking, materials you provide, computer, Internet and electricity, accommodation and your time), or any other items as described in the course outline. You are solely responsible for all service, telephony, data charges and/or other fees and costs associated with Your access to and use of the Services, as well as for obtaining and maintaining all telephone, computer hardware, and other equipment required for such access and use. The cost will be paid in full, before the course is taken at the time of booking. Where discounts are applicable these will be time limited and must be claimed with the use of a valid discount code. Following the expiry of this discount the full rate for the course will be payable.

d) Payment. If You elect to access or use my services that involve payment of a fee, then You agree to pay, and will be responsible for payment of, that fee and all taxes associated with such access or use. If You provide credit card information to pay for such fees then You hereby represent and warrant that You are authorized to supply such information and hereby authorize myfamilygenealogy.co.uk to charge Your debit/credit card on a regular basis to pay the fees as they are due.

e) Cancelling all or part of your booking. If you need to cancel or postpone your booking you must give us written notice. The following cancellation terms apply to all bookings, discounted or paid in full:

For face to face taught courses please keep all personal belongings with you, in sight at all times. myfamilygenealogy.co.uk and Robert Parker will not be liable for loss or damage to these items. We cannot accept responsibility for loss of or damage to property or vehicles belonging to you, however caused.

g) Changes or cancellation by us of events beyond our control. We have the right to alter or cancel a booking that we cannot keep if the reasons for that are beyond our control. If this happens we will use reasonable efforts to offer an alternative.

h) You are over the age of 18, or, if not, You will only use the Services with the involvement, supervision, and approval of a parent or legal guardian. Children under the age of 13 may not register for an Account or register or purchase Courses.

i) Online courses. You will not upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation (commercial or otherwise) through the Services.

j) You will not post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libellous content or information.

k) You will not copy, modify, reverse engineer, reproduce, distribute, publicly display, publicly perform, communicate to the public, create derivative works from, deface, tarnish, mutilate, hack, interfere with, or otherwise use and exploit any myfamilygenealogy.co.uk Content, the Services or Courses or Submitted Content except as permitted by these Terms or the relevant Instructor as applicable.

l) You will not frame or embed the Services to circumvent the Services.

m) You will not impersonate another person or gain unauthorized access to another person’s Account.

n) You will not introduce any virus, worm, spyware or any other computer code, file or program that may or is intended to damage or hijack the operation of any hardware, software or telecommunications equipment, or any other aspect of the Services or operation thereof; scrape, spider, use a robot or other automated means of any kind to access the Services.

o) You will not disclose any personal information to an Instructor, and otherwise will assume responsibility for controlling how Your personal information is disclosed or used, including, without limitation, taking appropriate steps to protect such information.

p) You will not solicit personal information from any Instructor or other Student.

q) Registration. To use certain Services, You will need to register and obtain an account and password. When You register, the information You provide to Us during the registration process will help Us in offering content and customer service. You are responsible for maintaining the confidentiality of Your account, User Name, and password (collectively, Your “Account”) and for all activities associated with or occurring under Your Account. You represent and warrant that Your Account information will be accurate at all times. You must notify Us (a) immediately of any unauthorized use of Your Account and any other breach of security, and (b) ensure that You exit from Your Account at the end of each use of the Services. To the extent permissible under applicable law, we cannot and will not be responsible for any loss or damage arising from Your failure to comply with the foregoing requirements or as a result of use of Your Account, either with or without Your knowledge, prior to Your notifying Us of unauthorized access to Your Account.

r) myfamilygenealogy and Robert Parker take your personal information seriously and take great care of this, protecting it from being accessed or shared by unauthorised individuals or organisations. Please request a copy of our Data Protection Policy to appreciate the steps we take to collect, protect and process your data. Also note our Terms Of Website Use (Privacy Acceptable Use And Cookie) Policy.

s) You may not transfer Your Account to any other person and You may not use anyone else’s Account at any time without the permission of the Account holder. In cases where You have authorized or registered another individual, including a minor, to use Your Account, You are fully responsible for (i) the online conduct of such Student; (ii) controlling that Student’s access to and use of the Services; and (iii) the consequences of any misuse.

t) Animals and pets. No animals or pets of any kind, except guide dogs, are allowed on our face to face taught courses.

u) Behaviour on our courses. You must behave in such a way that you do not cause a nuisance or unreasonable disruption to the course or other participants. Should any participants refuse to, or appear to be unable to alter any aspect of their behaviour which is unacceptable to us, we reserve the right to ask you to leave the course. You agree to pay any loss or liability of any kind to us or any other person caused by yourself.

v) Termination. myfamilygenealogy.co.uk reserves the right to terminate, suspend, modify, or delete, at Our sole discretion, any (a) Submitted Content, Company Content, Courses, or any Service; and (b) Your access to Our Services or Your Account, as follows:

w) If You breach or violate any of these Terms or any of Our applicable policies myfamilygenealogy.co.uk may take action immediately without prior notice to You. If We take action pursuant to this section, We shall not have any liability to You for any Course(s) You may have purchased nor for any other use of Our Services associated with Your Account. For avoidance of any doubt, You understand and agree that You will not be compensated nor be eligible for any refund under any circumstances for any such access lost to Our Services, including without limitation to Course(s) You may have purchased;

x) We may also take action for any reason or no reason, in which case We will provide prior notice to You. If We take action pursuant to this section, (a) if You are a Student We will refund You for any access lost to Course(s) that You may have purchased during the one (1) month period prior to such termination.

y) You may terminate Your use of the Services at any time, either by ceasing to access them, or by deleting Your Account. We have no obligation to retain any of Your Account or Submitted Content for any period of time beyond what may be required by applicable law. Upon termination, You must cease all use of the Services and Content.

z) I maintain my knowledge and skills with regular continuing professional development. Reading, attending conferences and lectures and researching up to date, best practice in genealogy. I belong to The Association of Professional Genealogists (APG), The Society of Genealogists and Suffolk Family History Society.
